Effective date: 14 July 2026 Hosted at: https://kzaran54-a11y.github.io/pace-legal/terms.html
These Terms of Service ("Terms") are a legal agreement between you and Pace, an independent developer (sole trader) established in the European Union ("Pace", "we", "us"), governing your use of the Pace apps for iOS, Android, and web (bundle ID com.pacehq.pace) and any related services (together, the "Service"). By downloading, creating an account in, or using Pace, you agree to these Terms. If you do not agree, do not use the Service.
Pace is a personal day-planner: calendar and tasks, notes, a journal of "moments," nutrition logging, a daily mood/reflection log, recaps and personal records, a friends layer, and a map.
1. Eligibility
You must be at least 16 (or the minimum digital-consent age in your country, such as 13 in parts of the US) to use Pace. If you use Pace on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
2. Your account
You can use Pace as a guest (no account) or sign in with email/password, Sign in with Apple, or Google. You are responsible for keeping your login credentials and device secure and for activity under your account. Tell us at support@pacehq.com if you suspect unauthorised access.
3. The free core and Pace Plus (subscription)
- The planner core is free forever.
- Pace Plus is an optional auto-renewable subscription that unlocks deep history and heavy-storage extras. Current pricing: Monthly £1.99 or Yearly £14.99, each with a 7-day free trial for eligible new subscribers. Prices may vary by region and store, and the price shown at purchase governs.
- Billing is handled entirely by the App Store (Apple) or Google Play. Pace does not process your payment and never sees your full card details.
- Auto-renewal. Your subscription renews automatically at the end of each period (and at the end of any free trial) at the then-current price, and your store payment method is charged, unless you cancel at least 24 hours before the period ends. Any unused portion of a free trial is forfeited if you subscribe before it ends.
- Managing and cancelling. Manage or cancel your subscription in your Apple ID settings (iOS) or Google Play subscriptions (Android). Because Apple and Google manage billing, we cannot cancel a subscription for you.
- Refunds. Purchases are non-refundable except where required by law. Because billing is store-managed, Pace does not issue refunds — any refund request must go to Apple or Google under their policies, and statutory rights (e.g. UK/EU consumer withdrawal rights) still apply.
- Changes. We may change Plus features or pricing going forward; we will give notice as the stores and applicable law require, and price changes affecting an existing subscription are handled through the store's consent flow.
4. Acceptable use and zero tolerance for objectionable content
Pace lets you create content and, if you use the friends layer, share some of it with people you connect with. There is zero tolerance for objectionable content or abusive behaviour on Pace.
You agree not to:
- break the law, infringe others' rights, or upload content you have no right to share;
- upload, share, or transmit content that is unlawful, sexually explicit, obscene, hateful, harassing, threatening, violent, defamatory, or otherwise objectionable, or content that depicts or identifies other people without their consent;
- harass, bully, impersonate, stalk, threaten, or spam any other person — including through friend requests, shared plans, messages, or location sharing;
- reverse-engineer, decompile, tamper with, overload, or attempt to bypass the security or access controls of the Service (including the per-user data isolation described in our Privacy Policy);
- use the Service to build a competing product, scrape it, or resell access.
Reporting and blocking. Wherever content or another person appears in Pace, you can report it or block that person from inside the app. Reports come to us, and we review them and act — typically within 24 hours — by removing content that violates these Terms and suspending or permanently removing the accounts responsible. Blocking takes effect immediately: a blocked person can no longer see you, contact you, or appear anywhere in your app.
We may remove content and suspend or terminate accounts, with or without notice, to enforce these Terms or protect the Service or other users. You can reach us to report abuse at the contact address in Section 14.
5. Your content
You own your content — your events, tasks, notes, journal moments and photos, nutrition and mood logs, and everything else you create in Pace. We claim no ownership of it. You grant us only the limited licence needed to operate the Service for you: to store, back up, sync, and display your content on your devices and, if you use the friends layer, to show what you choose to share with people you connect with. This licence ends when you delete the content or your account, subject to routine backup rotation. You are responsible for your content and for having the rights to any photos or material you add.
6. Not medical, health, or professional advice
Pace lets you log things like mood, reflections, and nutrition, and shows you recaps and personal records based on what you enter. Pace is a planning and journaling tool, not a medical device and not a source of medical, dietary, mental-health, or other professional advice. Nothing in the Service is a diagnosis, treatment, or professional recommendation. Always consult a qualified professional for health decisions, and never disregard or delay professional advice because of something in Pace. In an emergency, contact your local emergency services.
7. Third-party services
Pace relies on third parties including the App Store and Google Play (billing), Supabase (auth and hosting), and map-tile providers such as OpenStreetMap and Esri. Your use of those services is also subject to their terms, and we are not responsible for them. Apple/Google note: where you obtained Pace through the App Store or Google Play, those stores' terms also apply; the store is not a party to these Terms, is not responsible for the app or its content, and has no obligation to provide support or handle claims relating to the app.
8. Availability; no guarantee
We try to keep Pace working and your data synced, but we do not guarantee the Service will be uninterrupted, error-free, or that data will never be lost. Because Pace is local-first, keeping your device backed up is a good idea. We may modify, suspend, or discontinue features.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Pace and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid Pace for the Service in the 12 months before the claim or (b) £50. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud), and your non-excludable statutory consumer rights are unaffected.
11. Termination
You may stop using Pace and delete your account at any time via Settings → Delete account, which erases your cloud rows and local data (see the Privacy Policy). We may suspend or terminate your access if you materially breach these Terms or to comply with law. Sections that by their nature should survive (content licence wind-down, disclaimers, limitation of liability, governing law) survive termination.
12. Changes to these Terms
We may update these Terms. If a change is material, we will update the effective date and, where appropriate, notify you in the app before it takes effect. Continuing to use Pace after a change means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the European Union member state in which the developer is established, without regard to conflict-of-laws rules, and the courts of that member state have jurisdiction.
Your consumer rights are unaffected. If you are a consumer in the EU/EEA or the UK, the mandatory consumer-protection laws of your country of residence still apply to you, and you may bring proceedings in the courts of your own country. EU consumers may also use the European Commission's Online Dispute Resolution platform.
